Urban and rural zoning by-laws
Milton has two zoning by-laws: 016-2014 applies to the urban areas and 144-2003 to the rural areas. We read only the urban by-law, in its March 2026 consolidation, so rural lots may have different fence rules. Confirm with the Town which by-law covers your property.

Fence height in the urban by-law
In a residential zone the maximum fence height is 2.0 m in an exterior side yard, interior side yard or rear yard, and no more than 1.0 m in a front yard, except 2.0 m along the common boundary where a front yard adjoins the rear yard of a corner lot. Height is measured to the highest point of each 3.0 m section, excluding decorative post caps, and may reach 2.3 m where grade varies if the lowest height of that section does not exceed 2.0 m. Section 13 also changes fence heights for named sites, so a lot-specific check is needed.

Daylight triangles are set by street type
The urban by-law allows no encroachment above grade in a daylight triangle or radius, and its list includes fencing. Table 4I sets a 5 m radius where two local streets meet, a 7 m radius where a local street meets a collector or an arterial, a 10 m radius where two collectors meet, and a 10 m triangle where a collector meets an arterial or two arterials meet.

Mature neighbourhoods
The Town’s Mature Neighbourhoods Character Study assessed the Mountainview neighbourhood and the part of Old Milton west of Ontario Street North and South in its second phase, and Zoning By-law 077-2021 applies new standards there. Its third phase covered Fallingbrook, Forrest Grove, Bronte Meadows, Valley View, Dorset Park and Timberlea; By-law 007-2022, enacted February 7, 2022, sets new standards for the low-density areas of Dorset Park and Timberlea. Ask the Town whether these standards affect your lot.
